SOUL SURF TRAVEL OR ITS SUPPLIERS CANNOT BE HELD ACCOUNTABLE IF YOU DONT SPEND THE TIME TO READ THE BELOW IMPORTANT INFORMATION,
TRAVEL INSURANCE:
When booking your surf holiday with Soul Surf Travel, travel insurance is mandatory to protect you from unforeseen circumstances throughout your journey. Soul Surf Travel can organise your travel insurance and recommends an unlimited medical cover, including medical evacuation, to be purchased at the time of the deposit being paid, to cover cancellation fees.
INTERNATIONAL PASSPORT AND VISA REQUIREMENTS:
It is the traveller’s sole responsibility to have 6 months validity remaining on their passport after the date you expect to arrive back into Australia. Please familiarise yourself with any visa and health requirements that may be applicable in the areas you intend visiting. Visa requirements can change, so if you book your holiday well in advance please ensure you check the current visa requirements prior to travel. You are responsible for obtaining any required visa and other travel documents, including all entry, exit, health and other documents which meet the requirement of the government authorities. Any expenditure incurred as a result of documents not meeting government requirements is your sole responsibility.
CANCELLATIONS AND REFUNDS:
Once paid the deposit is non-refundable and is in addition to any fees imposed by the supplier which may be up to 100% of the monies. Cancellations within 61 days of trip will be fully non-refundable. There will be no refund for cancellation once travel has commenced or for any unused services. The supplier’s cancellation fees will be charged according to their specific cancellation policy. All supplier cancellation fees will be displayed before you confirm your booking. If booking your own travel insurance please ensure that you’re covered for any unforeseen circumstance such as illness or accidents. All refunds from suppliers will be distributed once Soul Surf Travel has received them and not before. Soul Surf Travel shall not be liable, however the same may arise, for cancellation of journeys, deviations, delays or the failure to provide seat, berths, or facilities for carrying or storing luggage or for the failure to provide the travel services by the principals. The Soul Surf Travel is not liable in the event of any alteration or change of any kind made by any of our suppliers in respect of travel services following the acceptance of any booking by it and clients are responsible for any increases in charges which the suppliers may be legally and properly entitled to require.
FORCE MAJURE
Soul Surf Travel shall NOT be liable for any losses or damages due to events beyond their reasonable control including without limitation: acts or orders of governmental authorities; weather; fire; flood; earthquake; volcanic activity; lightning; airline delays or cancellations for any reason; utility outages; strike, lockout, or work stoppage; terrorism; or any event typically described as “force majeure” or an “act of God.”
PRICES FLUCTUATIONS AND EXTRA COSTS:
We reserve the right to vary prices and rates in the event of changes in exchange rates or price rises made by suppliers. We are not liable in any way if any increase occurs. All prices are quoted in Australian dollars and are subject to fluctuation in exchange rates until fully paid. No booking will be processed until the full deposit is received. The final payment is required 90 days before departure or supplier specific. If booked inside of 90 days full payment is required immediately. Costs not included in holiday price include but are not limited to excess baggage, personal spending money, travel insurance, airport departure taxes, passport and inoculation costs and meals other than those specified.
RESERVATION CHANGES:
Please note that all reservation changes are subject to availability and the terms and conditions of Soul Surf Travel and the relevant suppliers. Please bear in mind that most airlines and service providers treat a name change as a cancellation. All travel documents are non-transferable and must be issued in the name of the passport holder. Flights must be taken in the sequence they appear on your ticket confirmation. If you plan not to take a flight as booked, please contact the airline as soon as possible to discuss your options. It is your responsibility to ensure you have received all travel documents from us prior to travel.
INJURY: Soul Surf Travel (both for itself and on behalf of it’s suppliers and agents) does not accept any responsibility for any act, omission, default or neglect of themselves, it’s suppliers or agents, or of the suppliers and agents of it’s principals, for death, sickness, injury, damage, or loss to persons or goods whatsoever and howsoever the same may be caused. Soul Surf Travel and its suppliers recommend you bring your own first aid kit when traveling.
WEATHER EVENTS & GLOBAL EPIDEMICS: Tour delays, schedule changes or cancellation due to unforeseen weather (including natural disasters) & global epidemics are NOT the responsibility of Soul Surf Travel or its service providers. In such an event this happens to you, we will endeavour to find a replacement tour and/or help you make a travel insurance claim.
Unfavourable surfing conditions including on-shore winds, strong currents, very small or very large swells and the like are completely out of Soul Surf Travels control and do not serve as grounds to claim compensation and/or seek reimbursement.
DOCUMENTATION:
Our general practice is to send documents to our customers electronically whenever possible. We reserve the rights to charge an administration fee should you make a request for such documents to be sent as a hard copy.
REPORTING OF INCIDENTS & COMPLAINTS:
If you have a complaint during your holiday, please inform the relevant supplier immediately. If they are unable to resolve the matter, please immediately contact us at Soul Surf Travel. Any abnormal incidents including injuries, service problems, cancellation of service or dissatisfaction must be reported to Soul Surf Travel during the event to allow us an opportunity to rectify the situation or provide assistance.
CREDIT CARD SURCHARGES:
Credit card surcharges apply when paying using a credit card. Visa/ Mastercard 1.5% – Diners 2.89% – American Express 3.0%. If you pay for a trip with your credit card you must also agree not to charge back your payment to Soul Surf Travel. ALL PAYMENTS MADE VIA PAYPAL INCUR A 5% FEE!

PAYMENT TERMS: All tickets, resort, boat, villa & tour bookings will only be purchased by Soul Surf Travel once a deposit has been received which will be accepted in part payment of the total cost to be incurred by the clients, but receipt of a deposit does not constitute acceptance of a booking. The balance of the total cost is to be paid to the Soul Surf Travel in line with its supplier terms and conditions & not later than 60 days prior to departure (or such later date as may be specified in writing by the Soul Surf Travel). Failure by a client to pay the said balance by the due date will entitle the supplier or Soul Surf Travel to cancel the bookings made on their behalf of such client, whereupon the deposit paid shall be forfeited to the Soul Surf Travel & the supplier.
SERVICE PROVIDER INFORMATION: Soul Surf Travel does not warrant, and is in no way responsible for the accuracy of any information given or statements made by it’s service providers.
GROUP BOOKINGS: Soul Surf Travel reserves the right to modify any arrangements required by, or made on behalf of, clients and to cancel the same without notice in the event that Soul Surf Travel arranges bookings on behalf of clients based on reduced group rates and the group of clients wishing to take advantage of such rates are less than the minimum number specified by the supplier and Soul Surf Travel.
PARENTS OR GAURDIANS OF UNDER AGE TRAVELERS: If a parent or guardian signs a booking form on behalf of another person, s/he warrants that s/he has the consent of this other person, and s/he personally accepts all terms and conditions of Soul Surf Travel and it’s suppliers.
ENVIRONMENT: When booking your surf holiday with Soul Surf Travel you agree to act enviromentally responsible when on your holiday , helping to help us provide sustainable surf travel worldwide.
LIABILITY To the extent permitted by law, neither Soul Surf Travel nor any of its related bodies corporate, directors, employees or agents accept any liability in contract, tort or otherwise for any death, injury, illness,damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. Our liability will also be limited to the extent that any relevant international conventions, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, limit the amount of compensation which can be claimed for death, injury, or delay to passengers and loss, damage and delay to luggage. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Australian Consumer Law). This liability clause is subject to your rights under the Australian Consumer Law and nothing in these terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).
SPECIAL REQUIREMENTS Please liaise with your consultant regarding any special requirements you may have for your travel arrangements such as special meal and seating requests, room type or disabled access.
FREQUENT FLYER When booking with one of our consultants, please let them know your frequent flyer membership details (or other applicable loyalty program details) for inclusion in your booking. If you are booking online, please insert these details in the space provided for inclusion in your booking. Please check your frequent flyer program (or other applicable loyalty program) for the specific terms of your membership. We cannot guarantee that the supplier will credit you with points for your booking.
TRAVEL DOCUMENTS Travel documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date- changeable and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Please review your travel documentation carefully and advise us immediately of any errors in names, dates or timings. If you have booked with a consultant, it is your responsibility to collect all travel documents from us prior to travel. As a general rule your travel documents will be available for collection 2 weeks prior to departure, however this will depend on your individual arrangements. Please contact your consultant to confirm when your travel documents are ready for collection. If you have booked online, you should print out and retain your travel documents as provided to you by the website (or in a follow up email we send you).
SCHEDULE CHANGES We recommend that you contact the airline to confirm your scheduled departure time 24 hours prior to your flight.
MONIES NOT HELD ON TRUST All monies paid by you to us will be the property of Soul Surf Travel Pty Ltd and will be a debt due and payable to the travel service provider once the services to which the money relates have been provided (except for monies paid for flights with an IATA airline, which might be held on trust for that IATA airline). You agree and acknowledge that such monies will not be held by us on trust for and on behalf of you and we may hold such monies in any account as we see fit, including with our own and/or other customer monies.
GOVERNING LAW If any dispute arises between you and us, the laws of Australia will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Australia, and waive any right that you may have to object to an action being brought in those courts.
WHEN BOOKING YOUR HOLIDAY WITH SOUL SURF TRAVEL YOUR AGREEMENT WITH US:
ACCEPTANCE OF THESE TERMS AND CONDITIONS:
By booking your holiday with Soul Surf Travel or using our website or services, you are agreeing to be bound by these terms of this Agreement and any additional terms and conditions of any supplier that are relevant to your booking.
You agree on behalf of yourself and those you represent to comply with all terms and conditions including the payment of amounts when due.
You agree that any violation of such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel product or service, and (d) our right to debit your account for any costs we incur as a result of such a violation.
Soul Surf Travel does not accept any liability of whatever nature for the acts, omissions or default, whether negligent or otherwise of the service providers in connection with your contract between them and yourselves, over whom we have no direct control, whether or not written notice has been provided to you.
Soul Surf Travel are solely a travel agent working for both the service providers and yourself, and we are not responsible or liable for any issues you may have with the operator, as per the travel agents act.
Soul Surf Travel do not accept any responsibility or liability for death, disability, sickness including viruses, injuries, damage, loss, delays, additional expenses, inconvenience or climate conditions that do not match your expectations which are beyond our control, which was not preventable by reasonable diligence on our part.
Any legal issues must be taken up with the service provider you have entered into a contract with not Soul Surf Travel, and where unforeseen circumstances where liability cannot be excluded it is limited to the cost of the purchased travel arrangements.
Soul Surf Travel team will not be held liable if Mother Nature does not produce good waves during your trip, or be held liable for any reckless or dangerous behaviour including entering into situations exceeding your personal abilities including being affected by drugs and alcohol.
In the event of natural disasters, terrorism, war, civil unrest, strikes, industrial action, accidents and mechanical failure to transport carriers and service providers Soul Surf Travel shall not be responsible or liable.
Not all service providers can comply with all special requests relating to disability, age physical wellbeing, dietary requirements, baby seats, special medical conditions and Soul Surf Travel shall not be responsible and liable.
It is important to ensure you check all booking details carefully. If travelling internationally, please ensure all names are as they appear on passports. If Soul Surf Travel is not notified about any errors or discrepancies with ticketing in a reasonable amount of time, we will assume all details are correct. Corrections notified too late will be treated as a change of the booking.
Soul Surf Travel has taken due care and responsibility to verify and check all information on our website as at the time of compilation; however, as this information is supplied by the relevant service provider, it accepts no responsibility for any inaccuracy or misinterpretation.
Please note that some service providers charge an additional fee, either at check in or check out, which covers taxes, utility or local service fees etc.
Soul Surf Travel regrets that additional fees are beyond our control and, where possible and when they are known to us, we will advise guests of any additional fees.
